Box 482 NOTICE OF PUBLICATION Lynchburg, OH 45142 and UNKNOWN TRUSTEE OF THE PAUL H. ZIMMERER FAMILY TRUST AND/OR UNKNOWN HEIRS, DEVISEES, LEGATEES, SUCCESSORS, OR ASSIGNS AND SURVIVING SPOUSES, ADMINISTRATORS, EXECUTORS AND GUARDIANS, IF ANY, OF CATHY L. ZIMMERER DEFENDANT(S). Public Notice is hereby given that on the 4th day of August, 2025, the Highland County General Health Department, Ohio filed a Complaint in the Highland County Court of Common Pleas at Hillsboro, Ohio, for a solid waste and sewage public health nuisance, as described in that Complaint. The object of the action is to obtain from the court a judgment ordering Defendants to abate the solid waste and sewage nuisance. Such action is brought against the Defendants and he/she/they may be responsible for the cost of the action provided judgment is granted. 1. At all times relevant hereto, the Highland County General Health District was and is a general health district created under the laws of the State of Ohio. 2. At all times relevant, Cathy L. Zimmerer, Trustee of the Paul H. Zimmerer Family Trust was and is the owner of certain real property located at 2590 US 50, Hillsboro, Highland County, Ohio and said property was vested in the Defendant, Cathy L. Zimmerer, Trustee of the Paul H. Zimmerer Family Trust by a certain deed dated May 31, 2013 and recorded on June 5, 2013 in Vol. 841, Page 309 in the Official Records of Highland County, Ohio as more fully set forth in the attached Exhibit "A." 3. Defendant, Cathy L. Zimmerer, is the last known trustee of the Paul H. Zimmerer Family Trust. She has been deceased since January 19, 2019, as more fully set forth in the attached Exhibit "B." 4. Defendant, John R. Davidson is the known tenant residing on the property at the time this Complaint was filed with the Court. 5. Defendants, Cathy L. Zimmerer, Trustee of the Paul H. Zimmerer Family Trust and John R. Davidson have knowingly permitted a solid waste public health nuisance to exist upon the premises in violation of the rules and regulations of the Highland County General Health District and the Ohio Revised Code, specifically, ORC 3734.03 "no person shall dispose of solid waste by open burning or open dumping, except as authorized by the director of environmental protection in rules adopted in accordance with division (v) of this section 3734.01, section 3734.02, or sections 3734.73 of the Revised code and except for burying or burning the body of a dead animal as authorized by section 941.14 of the Revised code" and was duly notified by the Highland County General Health District that a solid waste public health nuisance exists and was duly ordered to abate the nuisance. 6. The Defendants, Cathy L. Zimmerer, Trustee of the Paul H. Zimmerer Family Trust and John R. Davidson have knowingly permitted a sewage public health nuisance to exist upon the premises in violation of the rules and regulations of the Highland County General Health District and the Ohio Revised Code, specifically, ORC 3718.011 & 3718.02 "the sewage treatment system is not operating properly due to a missing component, incorrect settings, or a mechanical or electrical failure" and/or "there is ponding of liquid or bleeding of liquid onto the surface of the ground or into surface water and the liquid has a distinct sewage odor, a black or grey coloration, or the presence of organic matter" and/or "prescribe standards for the regulation of gray water recycling systems" and/or "prohibit a sewage treatment system from causing a public health nuisance" and was duly notified by the Highland County General Health District that a sewage public health nuisance exists and was duly ordered to abate the nuisance. 7. Defendants, Cathy L. Zimmerer, Trustee of the Paul H. Zimmerer Family Trust and John R. Davidson have knowingly refused to abate the nuisances and as a result of the Defendant's willful refusal to obey the orders of the Highland County General Health District the threat to the health and safety of the community continues and if unabated irreparable harm will occur. Any person owning or claiming any right, title, or interest in the property above listed may file an answer in such action. Such answers shall be filed in the office of the undersigned clerk of court, and a copy of the answer shall be served on the prosecuting attorney twenty-eight (28) days after the date of final publication of this notice. Plaintiff demands judgment against the Defendant(s) and demands that the Defendant(s) be ordered to abate the public health nuisance located upon the premises, that the Defendant(s) be ordered to pay the costs of these proceedings and for such other and further relief as to which it may be entitled.
