Defendant In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction,") online at https://highland.sheriffsaleauction.ohio.gov on Thursday the 15th - 29th day of May at 10:00 o'clock A.M., the following described real estate, situate in the County of Highland, Union Township and State of Ohio, to-wit: EXHIBIT A Situated in the Township of Union, County of Highland, State of Ohio, being a part of V.M.S. No. 3782, and being all (53.677 acres) of the 52.5 "Parcel II" (Parcel Nos. 42-04-000-010.00) as conveyed to Josephine Fox and Brenda Cox and recorded in Official Record 954, Page 743 of the Highland County Recorder's Office, and being further bounded and described as follows: Beginning at a spike (found) under the pavement marking the centerline intersection of Collins Road (Township Road No. 135-A) and Panhandle Road (County Road No. 8-D), said spike having Ohio State Plane Coordinates Northing 467,392.880 feet, Easting 1,632,971.270 feet South zone and based upon NAD 83 (2011); Thence with the centerline of Panhandle Road North 77 degrees 41 minutes 03 seconds East, a distance of 598.31 feet to a P.K. nail (found) marking the Northwesterly comer of a 24.745 acres "Parcel I" as conveyed to Josephine Fox and Brenda Cox (O.R. 954, Page 743) and found in Survey Record Plat No. 3782-M-004 of the Highland County Engineer's Record of Land Surveys; Thence with the Westerly line of the aforesaid 24.745 acres "Parcel I" South 13 degrees 25 minutes 42 seconds East passing a 5/8-inch iron pin (found) 20.13 feet, a total distance of 1 4 13.43 feet to a 5/8-inch iron pin (set) marking a Northerly comer of an original 249 acres and 157 poles "First Tract" as conveyed to Nathan D. Brown and Jennifer L. Brown (OR. 886, Page 931); Thence with a Northerly line of the aforesaid original 249 acres and 157 poles "First Tract" South 77 degrees 49 minutes 32 seconds West, a distance of 1655.00 feet to a 5/8-inch iron pin (set) marking a Southeasterly comer of a 20 acres "Tract II" as conveyed to John Moore (O.R. 28, Page 686); seconds West passing a 5/8-inch iron pin (set) at 1384.43 feet, a total distance of 1409.43 feet to a P.K, nail (found) in the centerline of Panhandle Road; Thence with the centerline of Panhandle Road North 77 degrees 41 minutes 03 seconds East passing a P.K. nail (found) at 645.08 feet, a total distance of 1060.69 feet to the point of beginning, containing 53.677 acres of land, more or less. Bearings are based upon the Grid Azimuth (Az 101 degrees 41 minutes 15.0 seconds) between National Geodetic Survey and ODOT Cors Station "OHHI" and McCarty Associates Geodetic Survey Control Monument "2001 " and derived from GPS observations taken December 22, 2021, utilizing the Trimble ODOT CORS VRS (Virtual Reference System). Land surveyed in December 2021, under the direction of Jason C. McConnaughey, Registered Professional Surveyor No. 8509, the survey plat of which is referred to as Project No. S21-309 on file in the office of McCarty Associates, LLC, Hillsboro, Ohio. All iron pins (set) are 5/8-inch diameter with 1-1/4-inch diameter plastic caps stamped "McCarty Associates". PPN: 42-04-000-010.00 Property Address: 5966 Panhandle Road, Hillsboro, Ohio Prior Deed Reference(s): OR Book 954, Page 743 and OR Book 999, Page 3471 Said Premises Located at: 5966 Panhandle Road, Hillsboro, OH 45133 Said Premises Appraised at: $460,000.00 - Four Hundred Sixty Thousand Dollars and cannot be sold for less than two-thirds (2/3) of that amount. Proxy bids may be submitted seven days in advance of the sale on the website. If the property is not sold on the first sale date, it will be offered again on the second sale date at the same time and website with no minimum bid. No employee of the Sheriff's Office nor any of its affiliates have access to the inside of said property. Buyer beware. The property is being sold AS IS. A title commitment showing the showing the state of title to this real property is available for viewing by anyone in the file of this case in the Office of the Highland County Clerk of Courts. Purchaser shall be responsible for all costs, allowances and taxes the proceeds of the sale are insufficient to cover. TERMS OF SALE: A wire deposit MUST be received by 5:00 P.M. EST two business days prior to the auction date or an ACH debit deposit MUST be received by 4:00 P.M. ET five business days prior to the auction date in the deposit amount set by law ($2,000.00/ $5,000.00/ $ 10,000.00). Balance is due within thirty days of the confirmation of the sale, before the deed is delivered. If the Judgement Creditor is the purchaser, no deposit is required. Public notice is hereby given that all such real property to be sold at public auction may be subject to a federal tax lien that may not be extinguished by the sale and prospective buyers are urged to search the federal tax index, that is maintained by the county recorder, to determine if a Federal Tax Lien has been filed with respect to this property prior to the day of sale.
