PUBLIC NOTICE VILLAGE OF SINKING SPRING, OHIO ORDINANCE NO. 2025-01 AN ORDINANCE AUTHORIZING THE SALE OF REAL ESTATE OF THE VILLAGE OF SINKING SPRING, HIGHLAND COUNT, OHIO NOT NEEDED FOR ANY MUNICIPAL PURPOSE AND DECLARING THE SAME TO BE AN EMERGENCY. BE IT ORDAINED, by the Council of the Village of Sinking Spring, Highland County, Ohio two-thirds (2/3) or more of all members thereof concurring as follows: Section 1. That the following described real estate belonging to the Village of Sinking Spring in not needed for any municipal purpose, to wit: 1.001 Acres Being situated in the Village of Sinking Springs, Township of Brushcreek, County of Highland & State of Ohio, also being a part of VMS No. 3808 & being part of original 55 Acres, in D.B. 295 Pg. 323 owned by Leona M. Wylie and being Described as follows: Beginning at a spike set in the intersection of State Route 41 & State Route 124; thence with the centerline of State Route 124 S 88° 08' 53" E a distance of 131.00' to a spike set; thence S 88° 08' 53" E a distance of 111.96' to a spike found; thence S 88° 29' 03" E a distance of 799.20' spike set and being the true point of beginning; thence continuing with said centerline S 88° 29' 03" E a distance of 43.49' to a spike found; thence S 87° 29' 06" E a distance of 76.51' to a spike set; thence with three division lines S 02° 09' 11" W passing a 5/8" rebar set at 30.00' for a total distance of 363.00' to a 5/8" rebar set; thence N 87° 50' 49" W a distance of 120.00' to a 5/8" rebar set; thence N 02° 09' 11" E passing a 5/8" rebar set at 333.00' for a total distance of 363.00' to a spike set, which is the true point of beginning, containing 1.001 acres, more or less, and being subject to all legal right of ways, easements & restrictions of record. Bearings are based upon the N 87° 51' 00" W line. As recorded in Wylie Heights Subdivision Envelope 68B-69A. The above description is the division of a 55.172 acre contiguous tract of land a subject to the provisions of the Highland County Regulations for Minor Subdivision. An actual field survey was performed under the supervision of Ty R. Pell, Registered Land Surveyor No. 7524, on November 10, 2011 as found in file No. 11-138., Prior Deed Reference: O.R. Book: 803 Pg(s): 229-230 Parcel No.: 04-27-106-001.01 Section 2. That the Village Fiscal Officer be and hereby is authorized to advertise for the sale of said real estate by sealed bid to the highest bidder according to law, upon the following terms: (a) Cash at closing within thirty (30) days after acceptance of bid by Council of the Village of Sinking Spring; and (b) in addition to the bid price, purchaser shall also pay the costs of a new survey of said real estate (if necessary) and the costs of publication of the legal notice required to advertise the sale of said real estate. Section 3. The Council of the Village of Sinking Spring reserves the right to reject any bid of less than $ 20,000.00; otherwise reserves the right to reject any and all bids; and to waive any irregularities in the bids. Section 4. The premises, if sold shall be conveyed by official deed without warranty or evidence of title. The deed shall be prepared by the Village Solicitor, executed by the Mayor and the Fiscal Officer of the Village, and delivered upon the payment of the full amount of the sale price set forth in the accepted bid. Section 5. In accordance with Section 731.30 of the Revised Code this ordinance shall be an emergency measure necessary for the welfare and fiscal integrity of the citizens of the Village of Sinking Spring in that said real estate is not needed for any municipal purposes; and this measure shall be in full force and effect immediately upon its passage by the Council of the Village of Sinking Spring.
